Surf-anywhere members commit themselves to abide by the following end-user conditions. Preamble Surf-anywhere (web and mobile application) and its services are part of Bamar online B.V. (henceforward 'Bamar online B.V.') ,Surf-anywhere operates using the entire database on the network or only parts of it. By registering or subscribing the user will become part of Bamar online B.V.. The user of Surf-anywhere can be registered automatically, and receive the email services of other portals from the Bamar online B.V..

Definitions (1) Service or Site: The Service for which you are purchasing a Username and Password (E-ticket) from Bamar online B.V. to access the site and its materials.
(2) Subscriber: The End-user / Consumer, of the services of the site and holder of a valid Username and Password (E-ticket) for the site.
(3) User Profile: A Bamar online B.V. Pay User Account, opened and utilized by the End-user / Consumer who accedes to the terms and conditions outlined in this document. User Profile incorporates the Consumer’s personal information, including but not limited to email address, unique password, full name, home address, payment card information, and other.
(4) Payment Instrument: A payment method or tool enabling the transfer of funds.
(5) Access Credentials: The combination of your email address and the password that you select that enables you to have access to and utilization of the purchased Bamar online B.V. service

Access and signing up for Surf-anywhere In order to sign up at this site, you must accept the end-user conditions for using services provided by Surf-anywhere.

Devices (computers, applications, telecommunication devices, etc.) used to access the Services, as well as telecommunication fees necessary to use them are at the exclusive expense of the Member. In order to become a member of Surf-anywhere, one must be at least 18 years old or the age of majority in your jurisdiction and fill out all the mandatory fields on the sign-up form. The member guarentees that the information provided is accurate and corresponds to the truth. The member shall immediatly inform Surf-anywhere of any changes for the information entered during the sign-up process or, if need be contact Customer Support. That being said we do not guarantee the accuracy of information provided by users of the Service, or assume any responsibility to carry out checks to this effect: the user is the solely responsible for the content of profiles, public publications, messages, photos and other material that the user uploads to the Service or for the other users of the Service. If the indispensable conditions are fullfilled at the moment of signing-up. Surf-anywhere will provide one username and password via email. This will allow you to access the Service and its contents for which you are a purchasing member.

Billing Surf-anywhere will appear on your credit card or bank statement for all charges made. Bamar online B.V. may include other information on your statement based on credit card association, telephone regulation. The Electronic Payments Association (NACHA), and any other mandated rules and regulations.

Internet access The Licensed Software may require an internet connection to be available in order to access all features. See the specific provisions below that disclaim warranties and limit our liability based on internet service interruptions and unavailability.

Automatic renewal of the membership If a Member purchases one of the subscriptions on the Internet by credit card, it will be automatically renewed for the same duration of the subscription, if there's no cancellation request from the Member.

Note: the user accepts and authorizes the administration of Surf-anywhere to automatically renew the membership and conseguently charge the due amount by using the method of payment chosen by the User while purchasing the type of subscription.

Payment / Fee Depending on your location you will be billed in Euro (EUR), US Dollar (USD), British pound sterling (GBP). Bamar online B.V. provides unlimited access to our streaming video, ebooks, games and application content portals (e.g surf-anywhere.com). Normally on Sign up a Subscriber will receive a 3 day trial period at no cost or for EUR1, USD1, GBP1. If the user doesn’t actively stop their subscription within 3 days, they will be billed 29.99 EUR/29.99 USD/29.99 GBP on the 4th day and this 29.99 EUR/29.99 USD/29.99 GBP charge reoccurs every 30 days until the Subscriber actively stops the service. The member is responsible for such fees according to the terms of the site. Once a member has the ability to access the Service using the login assigned to the member, subscription fees become non-refundable.

Automatic Recurring Billing As agreed with on sign-up, subscription fees may be automatically renewed at the end of the original term outline on the Service, subscriber must notify Bamar online B.V. directly 24 hours prior to the end of the trial/special offer period in order to cancel automatic renewal. All trial/special offer memberships shall renew at the stated membership rate. Unless and until this agreement is cancelled in accordance with the terms hereof, subscriber hereby authorizes Bamar online B.V. to charge subscriber's chosen payment method to pay for the ongoing cost of membership. Subscriber hereby further authorizes Bamar online B.V. to charge subscriber's chosen payment method for any and all additional purchases of services and entertainment provided by the Service.

Functioning of Surf-anywhere site and relative services The Member must have the applications and make the necessary settings for Surf-anywhere to function correctly: browser IE, Firefox, Chrome or other ones correctly updated, activating JavaScript functions, receiving of session cookies and accepting to view pop-up windows. Surf-anywhere does not guarantee that the services can be used if the Member uses a pop-up window blocking utility. In that case, this function will have to be deactivated before using Surf-anywhere. Furthermore, the Member must have the competences, tools and applications necessary to use the Internet and, if need be, Internet and telephone services, and acknowledge that the characteristics and constraints of the Internet allow him to guarantee the protection, availability and integrity of data transmission over the Internet. Under these terms, Surf-anywhere does not guarantee that the services will function without interruption or error. In particular, their use may be temporarily interrupted for maintenance, upgrades , technical improvement, or modification of the content of its mode of presentation. When possible, Surf-anywhere will inform its Members prior to maintenance work or updates. AOL, Safari Mac users, due to the specifics of their Internet browser, may encounter operating problems. Surf-anywhere will not be responsible in any case of failure due to the connection using this access provider. Moreover, Surf-anywhere shall not be held responsible for any malfunctions, inability to access or bad conditions of use of the Service Surf-anywhere due to unsuitable equipment, dysfunctions internal to access supplier, the network traffic and any other reason beyond the control Surf-anywhere.

The global responsibility of Surf-anywhere is limited to the amount actually paid by the Member for the service involved in a violation. Surf-anywhere cannot be held liable for indirect damages suffered by the Member under any circumstance, and in particular, for loss of data, damages to the image, reputation, etc. (also for the copies) or registrations done by the Member, since the Member is responsible for making backup copies.

Links The Surf-anywhere site or third parties can include links or other websites, different from the Surf-anywhere site, or other Internet sources. Surf-anywhere site or third parties could include hypertext links to other websites or other Internet sources other than Surf-anywhere site. Since Surf-anywhere cannot control those sites and outside sources, it cannot be held liable for their availability, content, advertisements, products and services or any other element available in or starting from those sites or external sources. Any dysfunction regarding a link must be communicated to the administrator or the webmaster of the site concerned. Consulting and/or using those sites and external sources are governed by their specific end-user conditions. If the result of research conducted on the Surf-anywhere site takes the Member to access sites, pages or forums whose title and / or content is a violation of applicable laws, the Member must cease consultation of the site. Otherwise it will be considered responsible for his actions, since Surf-anywhere is not.

Cancellation At any time, and without cause, subscription to the Service may be terminated by Bamar online B.V. or the subscriber upon notification to the other by electronic or conventional mail, by telephone. When the member requests the termination, subscription fees are NOT refunded. Subscribers are liable for charges incurred by them until termination of service. If you request cancellation or request a refund from Bamar online B.V. your bank, card issuer, or phone company due to unauthorized or fraudulent use, Bamar online B.V. can at its discretion, to prevent further unauthorized use, block your information from use at all Bamar online B.V. Websites. This will not, however, prevent unauthorized use at non-Bamar online B.V. Websites, and is not a substitution for your contacting your appropriate channels to prevent further misuse.

Refunds When the member requests the termination, previous paid subscription fees are NOT refundable. The subscription is terminated (and no longer billed) after the current subscription month ends. Should a refund be issued by Bamar online B.V. all refunds will be credited solely to the payment method used in the original transaction. Bamar online B.V. will not issue refunds by cash, check, or to another credit card or payment mechanism.

Authorization of Use Subscribers to a subscription Service are hereby authorized a single E-ticket to access the service or material located at this site. This E-ticket shall be granted for sole use to one subscriber. No material within the site may be transferred to any other person or entity, whether commercial or non-commercial. In addition, materials may not be modified, or altered. Materials may not be displayed publicly, or used for any rental, sale, or display. Materials shall extend to copyright, trademarks, or other proprietary notices there from.

Transfer of E-Ticket Access to a subscription Service is through a combination of a Username and a Password (E-ticket). Subscribers may not under any circumstances release their E-ticket to any other person, and are required to keep his or her E-ticket strictly confidential. Bamar online B.V. will not release Passwords for any reason, to anyone other than the subscriber or a member of a legitimate law enforcement agency investigating a fraudulent use of card complaint, or as may be specifically required by law or court order. Unauthorized access to the Service is a breach of this Agreement and a violation of law. Subscribers acknowledge that the owner of the Service may track—through the use of special software—each subscriber's entry to the Service.If any breach of security, theft, loss, or unauthorized disclosure of E-ticket information occurs, subscriber must immediately notify Bamar online B.V. or the site of said security breach. Subscriber will remain liable for unauthorized use of service until Bamar online B.V. or the site is notified of the security breach by email or telephone.

Supplementary Terms And Conditions I understand that by having checked the acknowledgement of Bamar online B.V. Terms and Conditions, I am affirming that I have read and understand the Terms and Conditions of this account and authorize Bamar online B.V. to bill my chosen payment method in accordance with the current Terms and Conditions. This agreement is governed by the laws of the Netherlands and you hereby irrevocably consent to the courts of the Netherlands in all disputes arising out of or relating to the use of Bamar online B.V.'s services.

Notice Notices by the site to subscribers may be given by means of electronic messages through the site, or by conventional mail.
